He then goes downstairs to the basement, where Ben is being held prisoner. He gives the food to Ben, and he starts talking about Locke's recent failure to find Jacob's Cabin, and says he is "more lost than he's ever been". Locke says he knows what he is doing, and leaves the room with the breakfast, and smashes the plate on the wall.

Sun says she wants to raise "her baby" at Seoul, and Jin corrects her, saying it is "our baby". Jack, Juliet, Charlotte, and Miles return, and tell everyone that Sayid and Desmond has gone on the helicopter to the Freighter. Sun asks why Kate is not here, and Jack says she stayed with Locke, and he does not know why.

Kate goes to Locke's house and asks if she can speak to Miles. Locke does not allow her to do this and says that while she thinks she is living in a Democracy, she is not. Kate says that it is a Dictatorship, and Locke says if it was, he would of shot her, and continued what he was doing. Kate leaves, and sees Hurley. She asks him if he knows where Miles is at, and he says he was moved from the Rec room to the Boathouse. She goes there, and asks Miles everything she knows about her. He says he will not answer until she does a favor for him.

Jack tries to contact the FreighterDaniel is looking at the Dharma food boxes on the beach when Jack approaches him, asking for the satellite phone. He phones them, but no one answers. Juliet sarcastically suggests phoning another number, like 911. Sun asks if the helicopter has made it to the Freighter yet, and Jack says he cannot get contact with the Freighter. He then says Locke does not know what he is doing, but Sun says that if that is so, why would Kate stay with him.

As Kate and Claire are doing the laundry, Aaron starts to cry. Clarie asks Kate to pick him up and carry him. Kate, who is stumbling, says she is not good with babies, and would probably upset him. Claire picks him up, and says the last thing she ever thought she would be good at was being a mother.

Miles and Ben talkSawyer goes to Locke's house, and plays Backgammon. After a little bit, he asks for Locke's word for not to hurt Kate. He says that Kate is going to break Ben out, and take him to Miles. They go to the boathouse, and discover Miles is not there. Kate had taken Miles to Ben. Miles asks if he knows who he is, and who the man he works for is. Ben says yes to both questions. Miles then says that he can tell his boss that Ben is already dead, and the only person who knows he is alive, Charlotte, will be "taken care" of, as long as he pays 3.2 million dollars. Ben wants to know why the amount is precise, and then Miles shouts at him, saying not to treat him like any of the survivors. Kate takes him out, and asks him everything he knows about her. He says her name, and that she is a fugitive, and says the crimes which she has committed. They leave, but are cut off by Locke and Sawyer, at the top of the staircase.

At the beach, Daniel and Charlotte are doing a memory experiment with Dharma cards. Daniel gets two of the three right, and says that he has not made any progress. Jack asks them why the phone is not working. Charlotte says there is another line that can be phoned, but only for emergencies. Juliet says that it is an emergency. Charlotte phones Regina, and puts the speaker-phone on. Regina picks it up, and Charlotte says the people want to talk to their friends, Sayid and Desmond. Regina says she doesn't know what she is talking about, and says that their helicopter is not their.

Locke places the grenade in Mile's mouthMiles is tied back up in the boathouse, and Locke enters. He picks up a grenade, and puts it in Mile's mouth, and removes the pin. Locke says that he will be fine if he does not talk or open his mouth. He says this is punishment for breaking the rules, and leaves the room with Miles panicking.

Kate is in bed with Sawyer, but acts strangely. Sawyer asks if she is pregnant. Kate says she is certain she is not pregnant. Sawyer is relieved, but Kate starts to leave. Sawyer says that she'll be coming back to him in a week after being with Jack, and Kate slaps him.

Kate goes to the courthouseFlashForward: Kate and her lawyer are going to the courthouse. She puts on sunglasses, and exits the car, where a crowd of people are at, asking her questions. Neither Kate or her lawyer says anything. In the courthouse, the bailiff reads a list of felonies Kate committed, but Kate pleads not guilty. She is taken to custody for the time being. There, the lawyer asks to bring her son to the trail, but she refuses to have her son there.

During the trail, Kate's lawyers calls Jack to the stand to testify. He says he met Kate on Oceanic Airlines Flight 815, which crashed in the South Pacific. The lawyer asks if he knew about Kate being a fugitive, and Jack replies that Kate told him, and that the Marshal died in the crash, but believes it was a mistake. He also says that there were 8 survivors of the crash, who swam ashore with the help of Kate. Kate says to stop, and the lawyer asks one more question: "Do you love the defendant"? Jack says "Not anymore".

Diane wants to see Kate's sonDiane Janssen, Kate's mother, comes to meet Kate. She says that her doctors have said that she has had only 6 months to live for the past 4 years. She says that she will not testify against Kate, if she sees her grandson. Kate says she does not want her anywhere near her child.

Back at the court, the attorney says the Diane cannot come to the stand because of her health condition. The judge decides to place the trail on recess. The district attorney offers Kate 4 years in prison. She does not agree to this offer. the attorney then says that she can have a 10 year in-state probation, to which Kate agrees on. She says she is not going anywhere because of her son.

After leaving the courtroom, and heading for her taxi, Jack is waiting. He says that he did not mean what he said in court. Kate says that she has heard that story too many times. Kate invites him over to her house to see her son, but Jack refuses, and offers to go out for coffee instead. Kate says she understands why he doesn't want to see her son, but does not want to talk about it over coffee. She says if he ever changes his mind, he can come over.

Kate and AaronKate arrives back home, and is greeted by the nanny. She says Kate's son missed her badly, but is currently asleep upstairs. Kate goes upstairs, into his room, where a two year old child with blond hair is sleeping. He wakes up, and sees Kate, and says "mommy", they hug, and she says Aaron.

OMG Moments:

New Clues:
  • While testifying during Kate's trial, Jack said that "8 of us survived the crash", leaving 2 survivors unaccounted for.
  • Kate adopted Aaron, and back in "Through the Looking Glass" she says "He'll be wondering where I am". That person is probably Aaron.

Questions:
  • Why would Claire send Aaron off the Island with Kate? Will Claire die?
  • Why did Kate jump so fast at the offer of 10 years probation & not leaving the state?
    • Becasuse she doesnt want to go back to the Island?
  • Why would Miles ask for exactly $3.2 million?

Trivia:
  • The book John picked from Ben's book shelf was VALIS 1981. A science fiction novel by Philip K Dick. The title is an acronym for Vast Active Living Intelligence System, Dick's gnostic vision of one aspect of God. (exerptfrom Wikipedia)
  • This episode takes place on Christmas Day, and December 26, 2004, the day of the Indian Ocean Tsunami.

Theories:Claire possibly chooses to stay on the island and gives her baby to Kate.Claire seems to be one of the speacial people that the island has chosen. So maby she has a higher urposepurpose on the island and decides to stay there. We know that people can choose to stay on the island because on the episode Something Nice Back Home when Jack confronts kate she says something about her comitment to Sawyer and Jack says "Sawyer chose to stay on the island." So we know just because people aren't part of the Oceanic 6(possibly Oceanic 8) it doesn't mean they are dead.
